These terms govern your use of the Car Key API website, API, customer dashboard, and lookup widgets (the “Service”), operated by Wynkoop Consulting LLC (“we,” “us,” or “our”). By using the Service, you agree to these terms. If you use the Service for a business, you represent that you have authority to bind that business. If you do not agree, do not use the Service.
1. The Service
Car Key API provides vehicle key and remote catalog and fitment information. It does not cut or program keys, verify vehicle ownership, or authorize access to a vehicle. Coverage varies by vehicle and product. Features, data, and availability may change.
2. Accounts and credentials
You must be legally able to enter into these terms and provide accurate account information. You are responsible for activity under your account, keeping credentials confidential, and promptly reporting suspected unauthorized access. Keep API keys on your server; do not expose them in public browser code, repositories, or URLs. Revoke compromised keys through your account.
3. Permitted use
Subject to these terms and your account's access limits, we grant you a limited, nonexclusive right to use the Service and integrate its results into your applications, websites, and business workflows. You may embed widgets using the provided tools. You are responsible for your applications, widget configuration, users, and compliance with applicable laws, including providing any required privacy notices.
You must not use the Service to facilitate theft, fraud, unauthorized vehicle access, or other unlawful activity; bypass authentication, usage billing, or access restrictions; interfere with the Service; distribute malicious code; or access another customer's information without authorization. Do not submit unnecessary personal or sensitive information. You may not resell access credentials or redistribute the catalog as a standalone competing data service without our written permission.
4. Usage, payments, and cancellation
Pricing and any free allowance are shown in your account and at checkout. By starting a paid subscription, you authorize recurring charges for usage under the pricing and billing schedule presented at checkout, including applicable taxes. Stripe processes payments and provides the billing portal.
Each successful vehicle lookup counts toward usage, including empty results, repeated requests, and each requested page of results. API keys and widgets share the account's allowance. Vehicle discovery, failed requests, HEAD requests, and sample widget previews do not count as billable lookups. A widget's usage is charged to its owning account.
You can manage or cancel your subscription through the billing portal linked from your account. The portal shows when cancellation takes effect. You remain responsible for charges accrued before cancellation becomes effective. Pausing a widget, revoking an API key, or disabling access does not itself cancel a subscription. Contact us promptly about billing errors or refund requests; any rights provided by applicable law remain unaffected.
We will give notice of pricing changes before they take effect for your subscription. You may cancel before the changed pricing applies. Access may be limited or suspended if your free allowance is exhausted or payment is overdue.
5. Verify fitment before relying on results
Catalog results are reference information, not a guarantee of compatibility. Data may be incomplete, outdated, or incorrect. Independently verify the vehicle, market, part number, frequency, transponder, and cutting or programming requirements with a qualified professional or authoritative product source before purchasing, selling, cutting, or programming a key. You are responsible for verifying lawful authority to perform any vehicle work.
6. Ownership and third-party services
We and our licensors retain rights in the Service, software, and catalog, except for the limited permission granted above. Product names, trademarks, images, and other third-party materials belong to their respective owners; inclusion does not imply endorsement. You retain rights in information and settings you submit and authorize us to use them to provide and maintain the Service.
Third-party payment services, linked websites, and businesses operating embedded widgets may have their own terms. We do not control their independent services.
7. Privacy
Our Privacy Policy describes the information we collect and how we use and disclose it, including request history, widget activity, and billing information.
8. Availability and suspension
We do not promise uninterrupted access or a particular service level unless separately agreed in writing. We may maintain, update, restrict, or discontinue features. We may suspend or terminate access for a violation of these terms, nonpayment, a security threat, or a legal requirement. Where practical, we will provide notice and an opportunity to resolve the issue. You may stop using the Service at any time; cancel any paid subscription separately through the billing portal.
9. Disclaimers and limits of liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, or availability.
To the fullest extent permitted by law, Wynkoop Consulting LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, business opportunities, or data arising from use of the Service. Our total liability arising from the Service or these terms will not exceed the greater of US $100 or the amount you paid us for the Service during the 12 months preceding the event giving rise to the claim.
These limitations do not exclude liability that cannot lawfully be excluded or limit rights or remedies that applicable law does not allow you to waive.
10. Changes and general terms
We may update these terms by posting a revised version and effective date. We will provide advance notice of material changes through the Service or your account email where practicable, and obtain consent where required by law. Changes will apply prospectively. If you do not agree to revised terms, stop using the Service and cancel any subscription before they take effect.
A separate written agreement with us controls if it expressly conflicts with these terms. If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision does not waive it. Provisions concerning accrued payments, ownership, disclaimers, and liability survive termination to the extent applicable.
